Terms & Privacy Policy Software License Terms & Privacy Policy – Please read these terms carefully before downloading, installing, or using TSF Launcher (“Product”). By downloading, installing, or using the Product, you acknowledge that you have read this agreement, that you understand it, and that you agree to be bound by its terms. If you do not agree to the terms herein, please do not download or use the software or use the services.

This end user license agreement is between you (“You”), as either an individual or as a business entity, and Cheetah Mobile. In exchange for your use of the Product, you agree as follows:

1. License 1.1 You acknowledge that you have only a non-exclusive and limited right to use the object code version of the Product on non-commercial purposes within the validity period of the agreement. You may make a single copy of the Product in object code form for archival or backup purposes. You must include all Notices on all copies of the Product. You may not reverse engineer, decompile or disassemble the Product or attempt to gain access to the source code for the Product, except and only to the extent that it is expressly permitted by applicable law, and, to the extent applicable law permits contractual waiver of such right, you hereby waive your rights to do so. 1.2 You will not transfer or assign the Product or this EULA and/or any rights or obligations hereunder without the prior written consent of TSF Launcher. 1.3 Your rights under this EULA will automatically terminate if you breach any of your material obligations under this EULA. Upon any termination of this EULA, you will destroy all copies of the Product promptly after such termination. 1.4 All rights not expressly granted are reserved.

2. Infringement Indemnity Neither Cheetah Mobile, nor its affiliates, subsidiaries nor the licensors will have any liability for any claim based upon or arising out of (1) Intentional or negligent acts of anyone other than the provider of Product; or (2) the combination, operation or use of the Product with any equipment, devices or software not supplied by TSF Launcher, or (3) the alteration or modification of Product.To the full extent permitted by law, this section states the entire liability of TSF Launcher, its affiliates, subsidiaries and the licensors and your sole remedy with respect to any claim of infringement.

3. Limited Warranty TSF Launcher does not represent or warrant that the Product will operate without interruption or will be error free. Especially in the following cases: (1) modification or alteration of the Product made without the prior written approval of TSF Launcher. (2) accident, neglect, misuse or abuse, or (3) exposure to conditions outside the range of the environmental, power and operating specifications provided by TSF Launcher.

4. Disclaimer and Limitation of Liability 4.1 Except as expressly set forth in this EULA, neither TSF Launcher, its affiliates, subsidiaries nor the licensors make any other warranties, express or implied, including any implied warranties of merchantability and fitness for a particular purpose. TSF Launcher, its affiliates, subsidiaries and the licensors expressly disclaim all warranties not stated in this EULA. Any implied warranties that may be imposed by law are limited to the terms contained in this EULA to the maximum extent permitted by law. 4.2 To the maximum extent permitted by law, in no event with TSF Launcher, its affiliates, subsidiaries and the licensors be liable for damages or losses for any cause whatsoever, and regardless of the basis of the claim or action.

5. Protection of Personal Information We promise that we will not collect any personal information which is not necessary for the services, and we will not use any your personal information for any purpose other than serving you.We provide privacy policy that as an important part of this agreement, you should read this policy and agree to its contents before installing and running the product.[Please see our Privacy Policy below]

6. Intellectual Property Any end user should not use TSF Launcher for infringement on the intellectual property rights of others, (including without limitation to patent, trademark, trade secret, copyright, and other proprietary rights), and if you, the copyright owner or an authorised representative, believe that any content infringes on your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing us with the information as follows: · A physical or electronic signature of a person authorized to act on behalf of the owner or an agent of an exclusive right that is allegedly infringed; · Identification of the copyright claimed to have been infringed; · Identification of the material that is claimed to be infringing; · Information reasonably sufficient to permit the service provider to contact you; · A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.We respect the intellectual property rights of others and will respond to clear notices of alleged infringement. You acknowledge that if you fail to comply with all of the requirements of this section, your notice may not be valid.

7. General Terms & Privacy Policy 7.1 This EULA constitutes the entire agreement between you and TSF Launcher with respect to the subject matter hereof and supersedes all previous and contemporaneous written and oral representations, proposals, negotiations and communications, including, without limitation, the Terms & Privacy Policy of any purchase order. 7.2 TSF Launcher may assign this EULA or any of the rights or obligations hereunder, and any causes of action arising hereunder, to any third party without necessity or obligation of notice to you. The waiver or failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further right hereunder. The invalidity or unenforceability of any provision of this EULA will not affect the validity or enforceability of any other provision, the remaining provisions being deemed to continue in full force and effect. 7.3 TSF Launcher will not be responsible for any failure to perform its obligations under this EULA due to circumstances beyond its reasonable control, including without limitation acts of God, war, riot, terrorism, embargoes, acts of civil or military authorities, fire, flood or accidents. You agree that TSF Launcher will be entitled to all legal and equitable remedies otherwise available to it to protect the intellectual property, proprietary rights and confidential information of itself and its licensors, including, without limitation, the right to seek and obtain injunctive relief and enforce the same against you without the necessity of having to post bond or other such guarantee. 7.4 This EULA will in all respects, be governed by and construed and enforced in accordance with the laws of Hong Kong Special Administrative Region. You consent to the jurisdiction and venue of the courts of TSF Launcher’s domicile for the resolution of any dispute arising under or related to this EULA or the Product.

8. Third Party Licenses Licensed under the Apache License, Version 2.0 (the "License"); you may not use this file except in compliance with the License. You may obtain a copy of the License at http://www.apache.org/licenses/LICENSE-2.0. Unless required by applicable law or agreed to in writing, software distributed under the License is distributed on an "AS IS" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or implied. As you use a launcher to organize your device, view your phone calls, search information, visit websites, manage the installed apps, etc., when you use these function, for example, typing a keyword and see related information from your devices or Internet via TSF Launcher, we collect information from you in order to provide corresponding service and better user experience to you. When participating in TSF Launcher user experience improvement program, as appropriate, your usage, statistics, input while using TSF Launcher, and crash reports would be collected.

What do we use your information for? Any of the information we collect from you may be used in one of the following ways: · To personalize your experience (Your information helps us to better respond to your individual needs, for instance, we use the fingerprint for the package name of installed applications in your device in order to intelligently organize these applications into different types / folders for you to access easily and intuitively.) · To improve our application (We continually strive to improve our application based on the information and feedback we receive from you) · To improve customer service (Your information helps us to more effectively respond to your customer service requests and support needs) · To administer a contest, promotion, survey or other site feature · To perform the examination for the potential security threat of your device (The potential SMS phishing threat via SMS Messages) · To send periodic emails The email address you provide in user experience improvement program or feedback your opinions to us, will only be used to respond your feedback, send you information and updates of our products and services.

What information do we collect? We collect information to improve our application and provide better services to all of our users - including: · The information you give us, for example, when you give us your opinions to our application and services via our feedback channel; · The information we get from your use of our application and services, like the keywords you type in our application to search, the websites link you input, click, interact, and trigger from any application in your device, and the fingerprint for the package name of installed applications in your device at the first time startup after TSF Launcher installation; · Log information, the application events such as version, installed date and time, usages statistics, crashes event, and dump reports of our application; · Location information, locale, and the MCC (mobile country code); · Device information, such as your hardware model, build fingerprint, ROM size, CPU model, device display DPI, android ID, Google advertising ID, phone type & model, network type, and operation system version, etc.; The information collected is under encrypted transmission in order to prevent and ensure our users privacy as we always concerned. We do not collect your personal identifiable information when you using our product, such as name, phone number, physical address.

Do we disclose any information to outside parties? We do not sell, trade, or otherwise transfer to outside parties your personal identifiable information. This does not include:Trusted third parties who assist us in operating our website, conducting our business, or servicing you, as long as those parties agree to keep this information confidential;We will access, use or disclose your information with other organizations or entities for reasons that required by any applicable law, regulation, legal process or enforceable governmental request;Detect, prevent, or otherwise fraud, security or technical issues;Protect against harm to the rights, property or safety of Cheetah Mobile, our users or the public as required or permitted by law

Security We are very concerned about safeguarding the confidentiality of your information. We do not collect Personal Information, and we employ administrative, physical and electronic measures designed to protect your Non-Personal Information from unauthorized access and use. Please be aware that no security measures that we take to protect your information is absolutely guaranteed to avoid unauthorized access or use of your Non-Personal Information which is impenetrable.

Sensitive Information We ask that you not send us, and you not disclose, any sensitive Personal Information (e.g., information related to racial or ethnic origin, political opinions, religion or other beliefs, health, sexual orientation, criminal background or membership in past organizations, including trade union memberships) on or through an Application, the Services or the Site or otherwise to us.

Children We do not provide service focus on Children. If you are under 13, you may use our application or services when you are with a parent or guardian.
